Terms of Service

Welcome to Clockly. These Terms of Service ("Terms") govern your access to and use of the Clockly website, mobile application, and physical kiosk software (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

🏢 1. Account Roles and Responsibilities

Employer / Customer: The entity purchasing the Clockly subscription. The Employer is responsible for configuring property settings, importing schedules, managing employee data, and executing payroll exports.
Authorized Users (Employees/Managers): Individuals granted access to the Service by the Employer. Users are responsible for maintaining the confidentiality of their PINs and NFC tokens.

Clockly acts strictly as a data processor. The Employer remains the data controller and is solely responsible for ensuring that their use of Clockly complies with local employment and labor laws.

⚙️ 2. Service Availability & Accuracy

We strive to ensure 99.9% uptime for the Service. However, Clockly relies on third-party infrastructure (such as Google Sheets APIs for shift synchronization). We are not liable for delays, data synchronization failures, or downtime caused by these external networks or the user's local internet connectivity.

While Clockly's payroll engine is heavily audited for mathematical accuracy, it is the Employer's ultimate responsibility to review and authorize all exported payroll data before processing financial payouts.

🔒 3. Data Processing & Security

We implement industry-standard encryption to protect your data. By using the Service, you consent to our collection of location data (via GPS Geofencing) and biometric/photographic data (via the Kiosk Terminal) strictly for the purpose of validating attendance. All data processing is outlined in our Privacy Policy.

⚖️ 4. Limitation of Liability

To the maximum extent permitted by law, Clockly and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or operational capacity, resulting from your use or inability to use the Service.

🛑 5. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without prior notice, if you breach these Terms or our Acceptable Use Policy. No refunds will be given if access is suspended due to a violation of these terms.
